Pre-emption right
The municipality has adopted By-law No. 265 regarding the exercise of pre-emption rights on immovables within the Township of Gore. This by-law enables the municipality to exercise a right of first refusal on properties designated for future municipal projects. Under this right, the municipality may acquire properties by matching a purchase offer submitted by another buyer. The right is strictly confined to municipal development purposes.
The pre-emption right is applicable only to properties for which the Township of Gore has registered and published a notice of liability in the land register. This notice remains valid for a period of 10 years from the date of its publication.
If your property has been subject to a notice of liability for the right of pre-emption, no action is required on your part as long as no purchase offer has been made by a buyer.
However, if you wish to sell your property and receive a purchase offer, you must notify the Municipality of the Township of Gore by submitting a notice of intention to dispose of an immovable subject to the right of pre-emption. A form is available below to assist you with this process.
Failure to promptly submit the completed and signed notice to the municipality upon receiving a purchase offer may result in the cancellation of the sale.
Once the municipality receives the notice of intention to sell, it has 60 days to inform you whether it intends to exercise its right of pre-emption and acquire your property. If this deadline is not met, the municipality will be considered to have waived its right of pre-emption, allowing you to proceed with the sale of your property.
Should the municipality choose to exercise its right of first refusal, it is required to pay the agreed purchase price within 60 days of notifying you of its decision.
